Terms & Conditions

Barad Marketing Solutions ("BMS", "we", "us") designs and builds custom websites for businesses. These terms govern every build we take on. Requesting a quote or paying a deposit means you accept them. Project-specific details (scope, page count, timeline, total price) live in your written proposal, which sits alongside these terms.

Every build starts with a $5,000 deposit. The deposit reserves your slot in our queue and funds the first phase of design and engineering. It is non-refundable.

The remaining balance is invoiced per the payment schedule in your proposal. Final payment is due before launch and before ownership transfers. If an invoice goes unpaid, work pauses until the account is current.

Until final payment clears, all work product (designs, code, content we produce) remains the property of BMS.

Upon receipt of final payment, you receive 100% ownership of your website. We transfer the source code repository, deployment project, domain configuration, and all source assets we produced for the build to accounts you control. From that point the site is yours to host, modify, or extend with anyone you choose.

Open-source software used in the build (frameworks, libraries) remains licensed under its own terms; those licenses permit your full commercial use. We may display the finished work in our portfolio and marketing unless you ask us not to in writing.

Builds move at the speed of feedback. You agree to provide brand assets, content, account access, and review responses within a reasonable time. Delays on these extend the timeline without affecting the payment schedule.

Your proposal defines the scope. Revisions within that scope are part of the build. Work beyond it (new pages, new features, new integrations) is quoted and agreed in writing before it starts.

Ongoing updates, new pages, and content changes after launch are available under a separate monthly retainer. Without a retainer, our responsibility for the site ends at handoff.

We build to the engineering targets stated in your proposal and fix defects we introduced, reported within 30 days of launch, at no charge. Beyond that, the site is provided as-is. We do not guarantee specific business outcomes such as search rankings, traffic, or conversion rates.

Our total liability for any claim arising from an engagement is limited to the fees you paid us for that engagement.

You may end an engagement at any time in writing. Fees already paid (including the deposit) are not refunded, and you receive the work completed and paid for up to that point. We may end an engagement if invoices remain unpaid or the working relationship breaks down; in that case the same rule applies.

These terms are governed by the laws of the State of California. If any part of them is found unenforceable, the rest stands. We may update these terms; the version published here at the time you pay your deposit is the one that applies to your build.
